Pharmaceeka is an online pharmacy staff recruitment website and agency used for the advertising and placement of locum, part-time and full-time pharmacy staff in both retail and hospital pharmacies across Australia. Pharmaceeka is not a health or medical care provider and does not provide pharmacy staff, doctors, nurses or any other health or medical professionals to the public directly.

Set out below are the terms and conditions for the locuming and permanent placement services of employees and are considered to be accepted and effective upon engagement of Pharmaceeka services.

Employees / Pharmacists / Locums/ Pharmacy Assistants etc:

  1. All registrants need to declare that all details entered upon registering are true and correct(ie. Pharmacists are qualified and registered pharmacists). Pharmaceeka does not warrant the accuracy of the data provided by registrants or accept any liability for inaccuracies or omissions
  2. Pharmaceeka is solely set up for the use of authorised and registered pharmacists and pharmacy employees and use of the website by external recruitment agencies is strictly forbidden.
  3. All registrants are prohibited from communicating contact details etc. of listed pharmacies on the website to outside parties.
  4. Pharmaceeka is not the employer of any registrants of the Pharmaceeka website and holds no responsibility over the actions of the registrant nor does the registrant have any authority to act for or on behalf of Pharmaceeka. Pharmaceeka does not take responsibility for the personal/professional conduct of the employer and/or other employers of the pharmacy sourced through the website.
  5. Wages and rates are not the responsibility of Pharmaceeka and are to be arranged between employer/employee prior to commencement of employment and followed up independently from Pharmaceeka. This applies to all forms of employment, including locum, full-time, part-time and casual employment. Unless otherwise arranged, the standard rates of payment for locums are as follows: Monday-Friday 9am-6pm (T): $40+Super, Weeknights 6-9pm and Saturdays (T1/4): $50+Super, Weeknights after 9pm, Saturdays after 6pm, Sundays, P/Hol: $60+Super.
  6. All registrants agree when registering with Pharmaceeka that their details will become viewable to all pharmacy owners/managers registered with Pharmaceeka unless their account is switched to ‘Hidden’ in their profile.
  7. All registrants give permission to both Pharmaceeka and pharmacy owners registered with Pharmaceeka to contact any referees listed in their résumé and access their résumé for the purposes of obtaining work for the registrant. 
  8. All registrants agree to honour shifts once they have been accepted and if for any reason a shift must be cancelled, altered or rescheduled they must give at least 48hrs notice to the either (i) pharmacy owner if sourced through the Pharmaceeka website or (ii) directly to Pharmaceeka admin if sourced through the agency avenue. Cancellations and rescheduled placements must be only be made on reasonable grounds.
  9. All registrants agree to be contacted by email, telephone or SMS regarding shifts/jobs available through Pharmaceeka
  10. Pharmaceeka reserves the right to cancel the registration of any registrants, postings or comments that breach the terms and conditions or registrants that display inappropriate behaviour. Registrants must not, in using the Pharmaceeka website, (a) display any content that is defamatory, offensive, abusive, indecent, sexually explicit, menacing or harassing or likely to cause damage or injury to any person or property, (b) infringe or misuse a third party’s intellectual property rights or confidential information, (c) expose any person to the risk of legal or administrative action including prosecution under any law, (d) results in the sending of a virus, worm, trojan horse, trapdoor, software switch, time bomb, slicing routine, corruptive code, logic bomb, disabling code, disabling routine or expiration dates (as these words are generally understood within the technology industry) or any equivalent or similar corruptive mechanism, (e) use the Pharmaceeka website or services for any illegal purpose or which contravenes any law, code, standard or regulation, or (f) impersonate another person or entity or otherwise mislead or deceive as to the registrant’s identity.
  11. All pharmacist registrants agree and undertake that upon registering with Pharmaceeka that both their AHPRA registration and PDL insurance is current and remains up to date throughout their entire registration period with Pharmaceeka.
  12. Locum registrants agree to make contact with the pharmacy owner/manager before any shift to organise any relevant information pertinent to that shift and also to arrange keys, alarm codes, etc. Registrants are requested to operate in an orderly and respectful fashion, arrive to all shifts on time, leave the pharmacy in a suitably tidy state, and communicate any important information relevant to staff in following shifts. Whilst dispensing prescriptions, pharmacists are required to follow all requirements set out by Australian law, The Pharmacy Board and PDL . Operating in a pleasant and professional manner will not only yield a happy employer but feedback requested by Pharmaceeka will significantly improve (or potentially harm) future prospects of work.
  13. Pharmaceeka reserves the right to withdraw any registrants or postings that breach the terms and conditions or registrants that display inappropriate behaviour either on the website or in the course of performing any work sourced through Pharmaceeka.
  14. Registrants agree to have comments written about them by employers or Pharmaceeka administration in the feedback section of their profile and are aware that this information is viewable to other employers registered with Pharmaceeka. This information will be deleted when the registrant deletes their account. 

Employers / Pharmacy Owners / Managers etc:

  1. All registrants declare that all details entered upon registering are true and correct. Pharmaceeka does not warrant the accuracy of the data provided by registrants or accept any liability for inaccuracies or omissions.
  2. Pharmaceeka is solely set up for the use of registered and approved pharmacy owners/managers and use of the website by external recruitment agencies is strictly forbidden.
  3. Employers are prohibited from communicating to outside parties about contact details etc. of listed locums/employees on the website. 
  4. Pharmaceeka is not the employer of any registrants and takes no responsibility for the personal/professional conduct of the any registrants, nor does Pharmaceeka accept any liability of any kind for loss, damage to property or injury as a result of the actions of any candidates sourced through Pharmaceeka. All pharmacists registered with Pharmaceeka will have their registration verified as indicated in the pharmacists individual profile, however Pharmaceeka can not vouch for any unverified candidates. All pharmacists and pharmacy staff placed through the Pharmaceeka agency are fully verified and screened prior to placement. Pharmaceeka is not responsible for screening any staff sourced directly through the website itself and this remains the sole responsibility of the employer.
  5. Pharmaceeka make recommendations for placements based on information provided by both employee/employer and referees and/or feedback obtained from previous placements. Pharmaceeka is not responsible for misleading or inaccurate information provided and the employer accepts full responsibility for the selection of candidates.
  6. Any cancellations or alterations to previously confirmed shifts arranged through the Pharmaceeka website (ie. initiated directly by the employer) must involve the employer directly informing the relevant employee. Any amendments/cancellations of these shifts are solely the responsibility of the respective parties, not Pharmaceeka.

  8. Pharmaceeka reserves the right to cancel the registration of any registrants with the Pharmaceeka website, postings or comments that breach the terms and conditions or registrants that display inappropriate behaviour. Any comments made here are not to contain any defamatory or slanderous content. In particular, employer registrants must not, in using the Pharmaceeka website, (a) display any content that is defamatory, offensive, abusive, indecent, sexually explicit, menacing or harassing or likely to cause damage or injury to any person or property, (b) infringe or misuse a third party’s intellectual property rights or confidential information, (c) expose any person to the risk of legal or administrative action including prosecution under any law, (d) results in the sending of a virus, worm, trojan horse, trapdoor, software switch, time bomb, slicing routine, corruptive code, logic bomb, disabling code, disabling routine or expiration dates (as these words are generally understood within the technology industry) or any equivalent or similar corruptive mechanism, (e) use the Pharmaceeka website or services for any illegal purpose or which contravenes any law, code, standard or regulation, or (f) impersonate another person or entity or otherwise mislead or deceive as to the employer registrant’s identity.

Confidentiality

  1. A party that receives confidential information (the “Recipient”) of another party (the “Discloser”) through the Pharmaceeka website must (a) maintain the confidentiality of the confidential information, (b) take appropriate measures to secure the confidential information so as to prevent unauthorised access, (c) not disclose any aspect of the confidential information to a third party, (d) not use any of the confidential information otherwise than for the purpose for which the information was disclosed (“Relevant Purpose”), (d) not disclose or permit disclosure of the confidential information to any of its personnel, except for those of its personnel who require access to the confidential information for the Relevant Purpose, and then only to the minimum extent of that requirement, (e) procure that its personnel always comply with its obligations under this clause and (f) upon request cease all use of the confidential information and permanently delete all confidential information from any computers or other electronic storage devices owned or used by the Recipient.
  2. The confidentiality obligations upon a Recipient under these terms and conditions are in addition to and in no way detract from the equitable obligations of a Recipient in respect of confidential information.

Warranties, Liabilities and Indemnities

  1. Registrant warrants to Pharmaceeka that (a) registrant has the requisite power and authority to agree to these terms and conditions and to carry out the obligations contemplated by these terms and conditions, (b) registrant holds (and will at all times continue to hold) all rights permits, licences, authorisations and accreditations required for it to perform its obligations under these terms and conditions, and (c) information provided to Pharmaceeka is true and accurate in every particular.
  2. Pharmaceeka will have no liability whatsoever relating to any failure of, delay or interruption in the performance of Pharmaceeka website or services. In the event of failure of the Pharmaceeka website or services, Pharmaceeka will use its reasonable endeavours to restore the Pharmaceeka website and services.
  3. To the maximum extent permitted by law, Pharmaceeka excludes all warranties whether express, implied, statutory or otherwise, except for any warranty the exclusion or limitation of which would contravene any applicable law or statute, or cause any part of this clause to be void (“Non-excludable Warranties”).
  4. Pharmaceeka’s total liability to registrant for breach of any Non-excludable Warranty is limited to resupply of the services or payment of the cost of resupplying the services.
  5. Regardless of any other provision of these terms and conditions, Pharmaceeka’s total aggregate liability to registrant under or in any way connected with these terms and conditions is or the provision of the services is limited to an amount equal to the total fees paid by registrant to Pharmaceeka.
  6. Registrant indemnifies and must keep indemnified Pharmaceeka and its personnel (“Indemnified Parties”) from and against any liability and/or any loss, expense, damage or cost of any kind whatsoever suffered or incurred by any or all of the Indemnified Parties arising, directly or indirectly, from (a) a breach of any warranty or any term of these terms and conditions by registrant, (b) any negligent or unlawful act or omission on part of the registrant in the course of complying with these terms and conditions, (c) the posting of content on the Pharmaceeka website, and (d) any claim by a third party  against any of the Indemnified Parties relating to the Pharmaceeka services.
